Married Couple in Business (Qualified Joint Venture)
Filing Schedule C as a QJV Instead of Complex Form 1065 Partnership Returns
Spouses who co-own an unincorporated business can elect Qualified Joint Venture (QJV) status under IRC §761(f). This allows each spouse to report their share of business income and expenses on separate Schedules C, avoiding the cost and complexity of Form 1065.
What Qualifies as a Married Qualified Joint Venture?
Under Section 761(f) of the Internal Revenue Code, a business co-owned by a married couple can elect not to be treated as a partnership if all four of the following requirements are met:
The only members in the business are married spouses filing a joint Form 1040 return.
The couple files a joint federal income tax return (Married Filing Jointly).
Both spouses materially participate in the operation of the business under IRC §469 rules.
Both spouses elect QJV status by dividing all income, gain, loss, deduction, and credit on separate Schedules C.
Important State Law Consideration: State-Registered LLCs
In common law states (including New York), an entity formed as a state-registered LLC owned by spouses cannot elect QJV status under IRS rules—it is generally treated as a partnership unless it is located in a community property state (such as California, Texas, or Washington) under Rev. Proc. 2002-69. We review your exact entity status before making this election.
